(PRWEB) November 13, 2013 – Danziger & De Llano, a personal injury litigation firm representing a number of consumers impacted by the DePuy Articular Surface Replacement (A.S.R.) hip implant, praised news reports that indicate that a settlement has been reached between Johnson & Johnson and lawyers for patients injured by the defective product.
The reports indicated that the agreement would provide up to $4 billion dollars to address suits that have been filed, including case md-2197 in the United States District Court Northern District of Ohio.
Danziger & De Llano Provides Legal Support
Attorney Paul Danziger of Danziger & De Llano, a lawyer whose firm has been offering assistance to DePuy hip replacement patients who have needed the devices replaced, says that there is still much information outstanding about the terms of the settlement.
“We are optimistic about the terms that are being reported, but it is still unclear what the precise value will be for each individual who has impacted by the defective devices. The damage that has been done to patients has been devastating, and they deserve fair compensation for their pain.”
Danziger indicated that if the figure of $4 billion is correct it would be one of the largest product liability settlements in history for a defective medical device.
An article that appeared in [The New York Times on November 13, 2013, written by Barry Meier, a reporter for the paper, indicates that a tentative settlement offered by Johnson & Johnson would provide payments to hip replacement patients who have needed the orthopedic device removed and an alternative device replaced.
The article states that the payments are expected to average $350,000 per patient, though the actual figure will be impacted by a number of variables. A separate article found on Bloomberg’s Businessweek website reported that there are more than 7,500 lawsuits against Johnson & Johnson’s DePuy orthopedic devices unit currently on file in federal and state court that would be resolved by the tentative agreement.
The reports indicate that the attorneys involved expect an official statement will be released by Johnson & Johnson soon.
